Terms of Service

1. Who you are contracting with
The Animaitor service ("Service") is provided by Die Quadratur UG (haftungsbeschränkt) ("Animaitor", "we", "us"). By using the Service you enter into a binding agreement with us.
2. Acceptance
By creating an account or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service. You confirm you are of legal age and, if acting for an organisation, that you have authority to bind it.
3. The Service
Animaitor lets you upload SVG logos, generate animations using a curated library of motion presets, and export the results as GIF, WebM, or SVG.
4. Acceptable use
You must not misuse the Service. In particular, you must not use it to upload, generate, or distribute:
- Content for any unlawful, fraudulent, deceptive, or harmful purpose.
- Material you do not have the rights to use, or that infringes third-party intellectual property, trademarks, or publicity rights.
- Content that is defamatory, harassing, hateful, sexually explicit, that sexualises or endangers minors, or that promotes violence, terrorism, or self-harm.
- Deepfakes, impersonations, or misleading depictions of real people, brands, or organisations without clear authorisation.
- Disinformation, deceptive political content, or content designed to defraud, manipulate, or scam others.
- Malware, phishing assets, or content that facilitates illegal activity.
- Adult, gambling, weapons, or other regulated content where prohibited by applicable law or by Paddle's Acceptable Use Policy.
You also must not:
- Attempt to bypass safety filters, jailbreak the Service, or extract underlying models, prompts, or training data.
- Send spam, malware, or attempt to interfere with the security or integrity of the Service (scraping, probing, reverse engineering, circumventing limits).
- Resell, sublicense, or redistribute the Service or its Outputs as a competing service.
5. Your content and outputs
You retain ownership of the logos and other materials you upload ("Inputs") and the animations you generate ("Outputs"). You grant us a limited, worldwide licence to host, process, and display your Inputs and Outputs solely to provide, secure, and improve the Service. You are solely responsible for your Inputs, for any prompts or parameters you provide, for verifying that you hold all necessary rights, consents, and licences in your Inputs (including in any depicted brand, logo, person, or trademark), and for how you use the Outputs — including any review, editing, and compliance with applicable law before publication or commercial use.
We may, at our sole discretion, remove content, refuse to generate or deliver Outputs, filter or watermark Outputs, restrict features, and suspend or terminate accounts that violate these Terms or present a legal, safety, or fraud risk. We act on valid rights-holder complaints and will terminate accounts of repeat infringers. To report infringing content, contact us at the address on our website with sufficient information to identify the work and your rights in it.
5a. AI-generated content and accuracy
The Service uses automated and AI-assisted systems to generate animations and related content. Outputs are produced algorithmically and may contain errors, artefacts, or unintended results, may resemble outputs generated for other users, and are not guaranteed to be unique, original, or fit for any particular purpose. You must review Outputs before relying on them and must not use them as a substitute for professional advice (legal, financial, medical, or otherwise). You are responsible for ensuring your use of Outputs complies with applicable law and any third-party rights.
6. Our intellectual property
We retain all rights, title, and interest in the Service, including software, motion presets, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan.
7. Plans, payments, and subscriptions
Paid plans and pay-as-you-go purchases are described on our Pricing page. Payment, billing, taxes, currency conversion, invoicing, subscription renewals, cancellations, and refunds are handled by Paddle and are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled. You can cancel at any time from your account.
8. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9. Service availability
We work hard to keep the Service available, but we do not guarantee uninterrupted, secure, or error-free operation. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Liability
To the maximum extent permitted by law, our aggregate liability under these Terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion would be unlawful.
11. Suspension and termination
We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends and we may delete your stored content after a reasonable export window.
12. Changes to the Service or Terms
We may update the Service and these Terms. Material changes will be communicated by email or in-app notice. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the Federal Republic of Germany. Courts at the seat of Die Quadratur UG (haftungsbeschränkt) have non-exclusive jurisdiction, subject to mandatory consumer-protection rules in your country of residence.
